계약 / Agreement

1. 00 [이용약관 준수 / Compliance with the Terms of Use]

   다음 "이용약관"은 영어로 작성되었습니다. 모든 사용자는 영어 버전이 번역된 버전보다 공식적인 "이용약관임에 동의하고 이해합니다.

2. 01 [계약 / Agreement]

   사용자는 매장에서 제공하는 서비스에 참여할 때 이러한 "이용약관을 준수하는 데 동의합니다. 어떤 상황에서도 합의 없이는 서비스가 제공되지 않습니다.

3. 02 [사용자 조건 / User Condition]

   사용자는 다음 4가지 조건을 모두 충족해야 합니다. 조건 중 하나라도 충족하지 않는 경우 서비스를 이용할 수 없습니다. 조건을 충족하지 않음에도 불구하고 서비스를 이용하는 것이 판명되면 보험이 적용되지 않음을 인정합니다.
   
   The User must fall under the following 4 conditions. If the User fails to fall under with either 1 of the conditions, the User will not be allowed to use the service. If the user is found to be using the service even though the User does not fall under the conditions, then the User acknowledges that insurance will not apply.

   A) 사용자는 일본에서 운전하기 위한 유효한 운전면허증 또는 허가증을 소지해야 합니다(1949년 제네바 협약에 기반한 국제운전면허증, SOFA 라이센스 등).

   B) 사용자는 서비스를 이용하기에 충분한 운전 기술을 보유해야 합니다.

   C) 사용자는 당 매장이 닌텐도 및/또는 게임 '마리오 카트'와 무관하다는 것을 이해해야 합니다.

4. 03 [교통법규 준수 / Compliance with Traffic Laws]

   사용자는 모든 지역 교통법규와 규정을 준수해야 합니다. 사용자는 일본에서 운전하기 위한 유효한 운전면허증 또는 허가증을 소지하고 항상 휴대해야 합니다. 사용자는 카트를 운전하기에 충분한 운전 기술을 보유해야 합니다.
   
   The User must obey all local traffic laws and regulations. The User must have a valid driving license or permit to drive in Japan and must carry it at all times. The User must have sufficient driving skills to drive the kart.

5. 04 [카트 책임 / Kart Responsibility]

   일본에서는 법률에 따라 카트가 지역 교통법규를 위반하지 않도록 기능 이상 없이 운영 가능한 상태임을 확인하는 것은 사용자의 책임입니다. (예: 측면 신호등, 헤드라이트, 테일라이트, 브레이크 라이트, 브레이크, 가속)
   
   In Japan, by law it is the Users responsibility to make sure the kart is operable with no dysfunctions that violates any local traffic laws. (Example:Side Signal Light, Headlights, Taillights, Break lights, brakes, acceleration)

6. 05 [교통법규 위반 등 / Violation of Traffic Laws, etc.]

   각 사용자는 모든 교통 위반에 대해 책임을 집니다. 당 매장이나 투어 가이드는 위반으로 인해 발생한 벌금이나 수수료에 대해 책임을 지지 않습니다.
   
   Each User will be responsible for any traffic violations. The Shop or tour guide will not be liable for any fine or fees incurred by the violation.

7. 06 [미해결 벌금 및 수수료 / Unresolved fines and fees]

   당 매장은 사용자가 지방 당국과의 교통 위반과 관련하여 부담한 미해결 벌금 또는 수수료를 청구할 수 있습니다.
   
   The Shop may charge any unresolved fines or fees incurred by the User regarding traffic violations with local authorities.

8. 07 [교통사고 / Traffic Accidents]

   교통사고가 발생한 경우 사용자는 투어 가이드, 지방 당국 및 보험 회사에 알려야 합니다.
   
   In the event of a traffic accident, the User must notify the tour guide, local authorities, and insurance company.

9. 08 [무단 합의 / Unauthorized Settlement]

   교통사고가 발생한 경우 사용자는 당 매장의 동의 없이 상대방과 합의하지 않기로 동의합니다. 당 매장은 사용자와 상대방 사이의 동의 없는 합의 계약에 대해 책임을 지지 않습니다.
   
   In the event of a traffic accident, the User agrees not to enter into a settlement with the opposing party without the Shop's consent.

10. 09 [카트 보험 / Kart Insurance]

    모든 카트는 사고에 대비하여 보험에 가입되어 있습니다. 보험의 적용 범위는 제한적이고 규제됩니다. 사고가 발생한 경우 보험 회사가 사건을 평가합니다. 이 시점에서 사용자는 50,000엔의 면책금을 지불해야 합니다. 보험 회사가 사고가 무모한 운전의 결과라고 평가하는 경우 사용자는 보상을 받지 못할 수 있습니다.
    
    All Karts are insured incase of an accident. The coverage of the insurance is limited and regulated. In an event of an accident, the insurance company will evaluate the incident. At this moment, the User must pay a disclaimer of 50,000 Japanese Yen. If the insurance company evaluate the accident is a result for reckless driving, the User may be neglected of coverage.

11. 10 [카트 손상 / Kart Damages]

    사용자는 카트에 대한 모든 손상에 대해 책임을 집니다. 사용자는 당 매장이 실제 손해를 청구할 것임을 이해합니다. 보험 회사가 관련된 손상은 제9조를 따릅니다. 당 매장은 손해에 대해 청구할 권리를 가집니다.
    
    The User is responsible of any damages to the karts. The User understands that the Shop will charge for actual damages. Any damages involving the insurance company will follow clause 9. The Shop has the right to claim for damages.

12. 11 [범죄 활동 및 조직 / Criminal Activity and Organizations]

    사용자는 자신이 범죄 조직의 구성원이 아니며 범죄 활동에 참여하지 않는다는 데 동의합니다.
    
    The User agrees that they are not a member of a criminal organization nor is participating in a criminal activity.

13. 12 [카트 전대 / Subleasing Karts]

    사용자는 당 매장이나 투어 가이드가 지정하지 않는 한 다른 사람에게 카트 운전이나 탑승을 허용할 수 없습니다.
    
    The User may not permit anyone else to drive or ride the kart, unless specified by the Shop or tour guide.

14. 13 [상업적 사용 / Commercial Use]

    대여 시 카트는 당 매장의 허가가 없는 한 상업적 용도(택배 서비스, 광고)로 사용이 허용되지 않습니다.
    
    The karts, when rented shall not be permitted to use commercially (courier service, advertisement) unless granted by the Shop.

15. 14 [카트 원상 복구 및 만능 반납 / Return Karts in Original Status, and Full Tanks]

    투어 고객의 경우 사용자는 투어 종료 후 연료 보급에 대해 책임을 지지 않습니다. 프리랜스 대여의 경우 필요한 유지보수를 제외하고 사용자는 당 매장의 동의 없이 스티커 부착이나 장치 설치 등으로 차량을 개조해서는 안 됩니다. 또한 차량은 원상태로 반납하고 사용자는 반납 전에 연료탱크를 가득 채워야 합니다. 사용자가 가득 채워서 차량을 반납하지 않는 경우 당 매장이 정한 요금을 지불해야 합니다.
    
    Regarding Tour customers, users will not be liable for filling the tanks after the tour has finished. Regarding freelance rentals, except for necessary maintenance, the User must not modify the Vehicle, etc., such as by attaching stickers or installing devices, etc., without the Shop's consent.

16. 15 [초과 시간 정책 / Over Time Policy]

    투어 고객에 대해서는 이 조항이 적용되지 않습니다. 프리랜스 대여의 경우 사용자는 당 매장이 정한 장소와 시간에 차량을 반납할 것을 약속합니다. 사용자가 대여 시간을 초과한 경우 당 매장의 동의를 얻어 연체료를 지불해야 합니다.
    
    Regarding tour customers, this clause does not apply. Regarding freelance rentals, the User is committed to returning the Vehicle, etc. at the place and time prescribed by the Shop. If the User exceeds the rental time, they must obtain the consent of the Shop and pay a late fee.

17. 16 [저작권, 초상권 및 퍼블리시티 권리 / Copyrights, Portrait and Publicity Rights]

    사용자는 카트 사용과 제공되는 서비스와 관련된 사진과 관련하여 저작권, 초상권 및 퍼블리시티 권리에 대해 어떠한 주장도 하지 않기로 동의합니다.
    
    The User agrees to make no claim whatsoever to copyright, portrait, and publicity rights related to photographs related to the usage of the karts and services provided.

18. 17 [손해 및 벌금 청구 / Claims for Damages and Penalties]

    사용자가 이러한 이용약관을 위반한 경우 사용자는 손해나 위반 벌금에 관해 당 매장이 제기하는 모든 청구를 보상할 것을 인정합니다.
    
    If the User violates these Terms and Conditions, the User acknowledges compensating any claims made by the Shop regarding damages or violation penalties.

19. 18 [매장 및 투어 가이드 결정 / Shop and Tour Guide Decision]

    사용자는 당 매장과 투어 가이드가 안전 위험(무모한 운전, 투어 규칙 미준수 등)에 따라 개별 사용자의 카트 운전을 중단시킬 권리와 권한을 가지고 있음을 이해합니다. 사용자는 당 매장이나 투어 가이드가 지정하는 대로 카트를 반납합니다.
    
    The User understands that the Shop and Tour guide has the right and authority to suspend a individual user from driving a kart depending on safety risks (reckless driving, not complying to tour rules, etc.). The User will return the kart as specified by the Shop or tour guide.

20. 19 [매장 면책 / Shop Disclaimer]

    당 매장은 사용자에게 발생한 모든 손해에 대해 책임이나 의무를 지지 않습니다. 당 매장은 사용자에게 제공하는 서비스를 중단, 취소 및 변경할 권리를 가집니다.
    
    The Shop will not be responsible and/or liable to any damages caused to the User. The Shop has the right to suspend, cancel, and change the service provided to the User.

21. 20 [언론 취재 / Press Coverage]

    사용자는 미디어 배포와 관련하여 데이터, 정보 및 이미지를 수집할 수 없습니다. 사용자는 당 매장의 허가 없이 데이터를 수집할 수 없습니다.
    
    The User may not collect data, information, and images in relation to any media distribution. The User cannot collect data without the permission of the Shop.

22. 21 [이용약관 변경 / Changes to the Term and Conditions]

    사용자는 이용약관이 사용자의 통지나 승인 없이 업데이트될 수 있음을 이해합니다.
